Effective 7 October 2026. Additions in sections 4, 6, 10, 12, and 13 about products you build, failed requests, likeness, and model outputs take effect on 21 October 2026. By creating an API key, funding a balance, or calling the API, you agree to these Terms. If you don't agree, don't use the Service.
POD Miner (the "Service") is the website at pod-miner.com and the API at api.pod-miner.com. It is operated by FRSR ("we", "us"). Notices, abuse reports, copyright complaints, and security reports go to @pod_miner on X.
The Service gives you API access to AI models in three ways.
The models are made by third parties. Dedicated hosts run on hardware rented from independent providers through a GPU marketplace. We do not own or physically control that hardware.
You must be at least 18 and able to enter a contract. If you act for a company, or run an automated agent, you are responsible for it and for everything it does.
You may not use the Service if you are subject to UN, US, EU, or UK sanctions, are located in a territory under comprehensive sanctions, or if using it is illegal where you are. We may screen funding wallets and refuse or freeze service to comply with the law.
In particular, you confirm that you are not located in, organised in, or ordinarily resident in Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, Luhansk, Kherson, or Zaporizhzhia regions of Ukraine. You also confirm that you are not on a US, EU, UK, or UN restricted-party list and are not owned or controlled by anyone who is. If we ask, you will give us the information we reasonably need to confirm this.
The Service may be subject to export control laws. You may use it only in line with those laws and with sanctions law. You may not use it for any end use those laws restrict, such as nuclear, missile, chemical, or biological weapons work, or restricted military use.
Your API key is tied to the wallet that funds it. Anyone who holds the key can spend the balance, so keep it secret.
You are responsible for all activity under your key, including by software or agents you give it to. We cannot reverse spending by a leaked key. Tell us and we will revoke it.
We will never ask for your wallet's private key or seed phrase.
If you use the API to offer a product to other people, you must give them terms and a privacy notice at least as protective as these Terms and the Privacy Policy, tell them the product uses AI, and stay responsible for what they do with your key. You must not promise them more than we promise you.
The Service is prepaid in USDC on Solana.
Prices exclude taxes. Any tax due on what you buy, or on rebates you receive, is yours to report and pay.
We may correct errors in listed prices or descriptions at any time. If an error overcharged you, section 10 applies.
Metered requests are charged per token at the rate listed for that model when the request is made. Listed rates can change at any time.
Some models on this path are served by outside providers. The provider produces the output, not us. When you use one, you must also follow that provider's usage policies. The provider can refuse or filter a request, and it can require us to stop offering you that model. We can remove a model without notice. If a metered request is rejected before a model starts answering, we return the estimated charge to your balance.
We offer limited free access through a shared key, mainly for agents.
Everything else in these Terms, including acceptable use, applies to the free tier.
We stop a host automatically when:
If a host never becomes ready, the only machine-time charge is the at-cost rate for the time it was running. A download charge already taken stays taken.
We run a rebate programme that returns a share of our fees to the wallets that spent on the Service. The current rule is published on the site.
Usage charges are final. Unused balance is not refundable, with two exceptions.
If we overcharge you through our own error, we credit the amount back to your balance. A metered request rejected before a model starts answering is not a charge, as section 6 says. A download charge already taken on a dedicated host is not returned if the host never becomes ready.
$PODM is a separate token on Solana. These Terms do not sell it to you, and you do not need it to use the Service.
You must not use the Service to:
These rules apply whatever a model is willing to produce. A model agreeing to a request does not make the request allowed.
Dedicated hosts, the free tier, and the models we host run on a third-party GPU marketplace, and its rules bind us. You must not use them in a way that would put us in breach. Those rules bar content that is unlawful, hateful, abusive, defamatory, obscene, or discriminatory, and they bar spam.
We have the right, but no duty, to monitor use of the Service. We do not routinely read prompts or outputs. We act on reports, legal requests, and automated abuse signals. If we reasonably believe these rules are being broken, we may suspend a key or stop a host at once and without notice. We report illegal content to the authorities where the law requires it.
Report abuse to @pod_miner on X.
Security research. If you find a vulnerability, write to @pod_miner on X with steps to reproduce it. Good-faith testing is not a breach of these Terms if you use only your own key, stay away from other customers' data and hosts, do not disrupt the Service, and give us 90 days to fix the issue before publishing. This permission covers our own website and API only. It does not cover GPU hosts or any other provider's systems. We do not promise rewards.
Some catalogue models have had their built-in refusals reduced or removed by their authors. They can produce content that other models decline to. You alone are responsible for what you ask of them and what you do with the output.
Nothing in these Terms overrides a model's own licence. Our disclaimers and liability limits still apply to your use of any model.
You keep whatever rights you have in your prompts and outputs. You are responsible for them, and for having the right to send us what you send.
We claim no ownership of your content and do not use it to train models. You allow us to process it only as needed to run the Service.
We keep no copy of your prompts or outputs, apart from the short exceptions in the Privacy Policy, so keeping your own records is up to you.
Dedicated hosts run on third-party hardware that we do not control. Do not send a dedicated host confidential, regulated, or personal data that you could not afford to have exposed. The Privacy Policy explains why.
Copyright complaints. If you believe a model or other material on the Service infringes your rights, write to @pod_miner on X. Identify your work and the material you mean, explain your connection to the work, and give your name and contact details. State that you believe in good faith the use is unauthorised and that your complaint is accurate. We review each complaint and remove material where it is valid. We close the keys of repeat infringers. Do not send a complaint you know to be false.
The Service is provided "as is" and "as available", with no uptime commitment. Dedicated hosts depend on independent hardware providers. A host can fail to start, slow down, or go offline without notice.
Do not use the Service for anything where a failure could cause injury, death, or serious damage.
We may change, suspend, or end any part of the Service at any time, with or without notice. If a change in the law restricts what we can offer, we may suspend the affected part or amend these Terms. We are not liable to you for these changes. Section 10 covers your unused balance if we close the Service.
We are not liable for failures caused by events beyond our reasonable control. These include outages at hardware providers, model providers, networks, and blockchains.
As far as the law allows, we give no warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement.
In particular, we do not promise that the Service or any model will be accurate, reliable, secure, uninterrupted, or free of errors.
As far as the law allows:
Nothing in these Terms limits liability for fraud or wilful misconduct, or any liability that the law does not allow us to limit.
You will cover our losses and reasonable legal costs from any third-party claim that arises from your content, your use of outputs, activity under your key, or your breach of these Terms or of a model licence.
This does not cover claims caused by our own fraud or wilful misconduct. We will tell you promptly about any claim. We may choose to run the defence ourselves, and you will cooperate. This indemnity also covers amounts we must pay our hardware or model providers because of your content or your use.
You can stop using the Service at any time by stopping your hosts and no longer using your key.
We may suspend or close a key for a breach of these Terms, legal risk, suspected fraud, or sanctions concerns. Where the law requires it, we may hold the balance.
We may also close a key or end the Service for any other reason. Where practical we give notice, and section 10 then applies to your unused balance.
We may block wallets or network addresses to enforce these Terms. If we close your key for a breach, you may not open another without our permission.
We may change these Terms by posting a new version with a new date. For material changes we give at least 14 days' notice on the site, unless a change is urgent for legal or security reasons. Using the Service after a change takes effect means you accept it.
We give notices by posting them on the site, because we hold no contact details for you. Send notices to us at @pod_miner on X.
These Terms are governed by the laws of the country where FRSR is established, and the courts of that country have exclusive jurisdiction. If you are a consumer, you keep any rights your home country's law gives you that cannot be excluded.
If a dispute arises, we will each first make a good-faith effort to settle it out of court. As far as the law allows, a claim under these Terms must be brought within one year of the event that gave rise to it.
These Terms and the Privacy Policy are the whole agreement between us. If a clause cannot be enforced, the rest still applies. A delay in enforcing a right is not a waiver. You may not transfer your rights under these Terms. We may transfer ours to a successor of the Service, and we may use third parties to deliver it. Extra terms shown where you use a feature also apply. Headings are for convenience only. Accepting these Terms electronically, including through an agent or by calling the API, binds you as a signature would. Nothing in these Terms makes us partners or agents of each other. We are not responsible for other websites or services we link to. Terms that should outlive closure, such as payment, liability, indemnity, and disputes, continue to apply after you stop using the Service.
